Black Bolt already lost his wife and kingdom albeit Johnny isn't king. It would have more impact if Scott and him had a personal rivalry. At this point it wouldn't really matter to either of them. The only way Scott could hurt him is he killed one of his family members. Probably Maximus since Scott could easily get away with that and nobody but black bolt actually likes him.

Are you seriously saying that is Scott's fault. The avengers were jealous petty losers to the point where even the biggest loser of all -Reed Richards- could see it. Making Scott take on all the other fragments increased the strain and attacking him was the stunt that pushed him over the edge.
Charles was the attacker, Scott was using self defence and that's without even including the mental drain and corruption of having 4 and then all five phoenix fragments

That said :
1) It was lawful in the sense that Scott was trying to protect his mind from assault.
2) It wasn't murder in the sense that the act wasn't premeditated, it was a spur of the moment act.
2) It was lawful in the sense that Scott was defending himself from a dangerous tresspasser.
