As someone who sells as cons, fanart always sells more. I hate making fanart so I rarely sell it but it sells more than twice as much as my original stuff.

People buying art of characters normally do so for characters they like, if the only exposure a con-goer has to your character is the print you have for sale they probably aren't going to buy it regardless of quality, unless they are in the market for a cool looking portrait of a generic cowboy/ninja/robot/whatever your character happens to be.

If you are an artist that wants to sell your original content you are going to have to get your characters out there first. be it by webcomic, indie comics or some other method.

If you're a halfway decent artist, fanart can make you hundreds of dollars in profit at even a small convention. I always HAVE my original content there, and I pitch it to people, but people always gravitate to prints or buttons or stickers of things they already like.

In the case of the OP image those would probably pass the original works test even though the artists doesn't own the IP, because they're not just trying to pass it off as their own. There's no case there.

Assuming that they pass the original works test or other tests that would obviate ownership of the depicted IP. If they're only really up there because the artists offer sketches of *anything* and they want to give an accurate indication of their style before someone commissions from them, they're not even crossing a line - because they aren't, necessarily, selling the IP as a product; once the artworks are created there's no point to going after the artists even if they are of a given IP (because the cost of legal action is non-negligible and also because of the Streisand effect, and that's assuming it was in any way cost effective to actually find out that someone occasionally draws your stuff at cons) and there's no recourse against the works unless they depict criminal acts.

However, difficult to prosecute effectively is not by any means the same thing as legal. If that same artist's print were to end up on tshirts mass-produced and sold, it's likely most companies would draw the line there and start sending C&Ds.

The only time I can recall a company stepping in to stop someone was with artist Gary Friedrich, co-creator of Ghost Rider. He sued Marvel claiming the rights to Ghost Rider reverted back to him, they countered with suing him for selling his sketches and advertising himself as "creator of Ghost Rider", and briefly preventing him from sketching and selling at cons.

Eventually they settled out of court for an undisclosed some (Gary got paid) and now they let him sell what he wants.

That's actually not a bad idea, there's an entire Art Village in Beijing dedicated to copying great works of art.

My problem with artist alleys is that they are all amateur people. There's a reason I don't spend money on them, it's because even though they are all good artists (sometimes), if all they can do is sell me fanart of other peoples characters, I don't give a shit. I'd much rather pay a lot of money for the original artist of a character or comic artist than just some printed fan art.

Other stuff I don't mind like the people who sell movie posters or backissues or some shit.
