I think they're trying to do what the comic event failed to. They want you to feel like both sides have a valid point. Tony's right that the team needs supervision, after his blunder with Ultron he realizes that superheroes shouldn't just have free reign. But Cap was unknowingly a pawn for Hydra disguised as SHIELD, and you understand him not really being too trusting of the government after that. Also Bucky has been his friend for the longest time, you can understand him wanting to help him. But Bucky did kill Tony's parents, you can totally understand why Tony isn't gonna just let him off because he was brainwashed.

I think the problem is that with the way cival war is being potrayed, with cap either getting unlimited power or being controled by government, obviously Tony becomes more sympathetic.
The biggest problem is that such a dichotomy is stupid, you don't need to have registration to control superheros, if the governmemt has the power to enforce registration, they can enforce laws normally. Its stupid to think that the only two choices are total government control or zero superhero accountability.
