Sorry, this is misinformation. You can record/photograph anyone in a setting where privacy is not expected, such as public places, your home, their home, anywhere you can visibly see someone. This does NOT include private acts, such as restroom/intercourse, etc. In most cases, to record sexual acts, you have to follow the laws in your area the same as one would have to follow to produce a pornography film, because that is essentially what you're filming, regardless of your intentions.

All of this depends on your local/state laws, of course.

Audio may be the same as video in this case, depending on your state laws. Audio produces identifiable sounds that are almost unique to each individual, similar to fingerprints, and you could be held liable in both a civil and criminal manner.

It's easier to ask and avoid the legal mumbo jumbo in your case, or not record altogether. Cases like this backfire 9/10.
