Teacher wants us to sit in the same seat for a few weeks to take roll/learn our names/etc...

I took some other seat, how am I supposed to approach something like this? This guy wasn't anything intimidating, super skinny guy with unshaven patchy hair. Fighting over a seat seems retarded, especially since it can get me expelled, but I don't want to come off as a push over either.
