I asked this yesterday, but it mainly became two people arguing with each other over something only partially related, so I'll try again.

The age gap thing is called Romeo and Juliet laws, and they are an exception that let you bang people beneath the AoC if you are close enough in age. This is mostly to prevent someone going to jail for turning sixteen while their girlfriend is still fifteen or whatever, when it was legal before the birthday.
There are probably some states with exceptions for parental consent, too, but I've never heard of it.
