CoC is something you are born with. It's not "you don't or can't have it because you're a Marine," it's "you don't and can't have it because you weren't born with it." Being born with CoC comes before you join the Marines. You're kind of saying the reverse, which doesn't make much sense.
A more logical conclusion would be that people born with CoC gravitate more towards being a Pirate than a Marine because of the reasons you stated.

Even Ace being his "brother" came out of no-where. The flashback was the first real time we got any info on Luffy's past. I'm not certain haki negates things like Luffy's rubber body or when Arlong threw him in the water, stretching out his neck shouldn't have worked, I think. But that's mostly because Luffy's df ability is passive, he can't really turn it on or off, not sure about people like Buggy and Alvida either, well Alvida probably has some control or she'd always be slipping off everything.
