He kills alright... but not as much as Hisoka. Wheren't you paying attention? If the original user dies he looses the stolen ability, which means that given the choice if the adversary is strong he won't kill him/her because he benefits more of leaving them live.
He is probably considering leaving Hisoka alive, he is going to underestimate him and Hisoka will kill him where he stands because even if he kills, he is before all else, a thief.
If this was to the death that is, he would lose. But it's probably not.
