I don't know if the author does it on purpose, he tries too hard to make Eri be portrayed on a positive light after her backstory showing how much of jerk she was/is but he puts a Stop signal that will never be something besides that girl that came too late despite having the advantage time wise.

The novels are still ongoing. In that regard, no one won the Kimito, at least not yet. Serious spoilers ahead.Volume 10 ends with Eri confessing to Kimito. Kimito, surprised by how sudden her confession was, is unable to to give a proper answer. He apologizes to Eri while also telling her that he is unsure of his feelings right now. Dealing with his birthday party and Eri's amnesia caused his mind to reach it's limit when she confessed to him.
Eri asks Kimito if he is in love with anyone. He answers with a no. Switching the question around, she asks if there was anyone he loved when he was younger. After a pause, Kimito answers that he was in love with Aika. It was love at first sight for his childhood self. Eri becomes silent after hearing this. A few seconds pass before she asks if he is still in love with her.
Kimito tells her that he doesn't know. Realizing that Aika was his first love didn't really change the fact that he doesn't know if he currently likes her or not. Eri, after hearing all of this, becomes silent. She asks Kimito again if he loves anyone right now. He tells her that he doesn't while hating the fact that this is the only answer he can give her. She goes on to whisper in a small voice that she still has a chance with him (as do the other harem members). On her mouth, a smile slightly emerges.
As the party winds up, the two return to the school only for Eri to collapse in Kimito's arms. The days passes and it's revealed that Eri recovered from her amnesia. The two of them talk with each other and Kimito notes that it's really nice having the old Eri back. As Kimito walks her to her vehicle, he notices that Eri is a lot more open that she used to be. In other words, she's now a mix of her old and new self. The volume ends with Eri giving Kimito a lovely smile while explaining an incident that happened between the two of them that Kimito only now caught on to.

Well yeah. You could say that for a few of the other heroines though. That TIPS chapter in particular with Kuroe was a bit painful to read.
As for the other point, you're right about that. Eri was pretty sharp to catch that Kimito was hiding something from her. It wasn't my intention to purposely avoid it though since that post was meant to be a short summery of what happened at the end of volume 10.
