Can jap police really just throw someone in a shitty empty cell just because they have a feeling they are a criminal? Can they force someone to be a witness and confine them to a room for however long they want them there?
>>
You make it sound like that doesn't happen everywhere else, disregarding the fact that AA takes place in an alternate universe.

The Japanese judicial system is pretty royally fucked up by American standards. Watching Locked Up Abroad: Japan quickly makes you realize that. The government wins 99% of criminal cases. Think about that for five minutes.
>>
>>140092854
hah! i remember watching a doco and part of it was how hard they were finding it to teach japanese people to wrap their heads around the jury system and the fact that they have to decide on the guilt or innocence of the accused, their extreme formal politeness seems to be at the heart of it

oh wait here's an article that discusses it better

20 days of prison before official charges are presented is possible, yes.
>>
>>140097812
23, and detainees don't have nearly as many rights as they do in a civilized country. Very long interrogations, browbeating, and sleep deprivation lead to most people signing confessions even if they're completely innocent (it's not like the Japanese police can be bothered to look for hard evidence)

>Can jap police really just throw someone in a shitty empty cell just because they have a feeling they are a criminal?

If you're from the USA, then you really are the one to talk. In your USA country, it has over three million people in prison and of course that doesn't include all the people who are out on probation as convicted criminals. A huge percentage of your population has seen jail and not just prison too. If you add both jail time and prison time together, America is the land of the unfree.

While the USA has 4.4% of the world's population, it has 22% of the world's prisoners. Sure, you say Europe and Japan are gay for letting so many people out. But in Japan, keeping people in prison for life is not the best thing for their taxpayers. Forcing the people to make restitution outside of prison (monitored) through labor is the popular approach.

No gang activity in Japanese prison because you are monitored 24/7.

Here's a French documentary about Japanese Prison with English subs about a French guy who was imprisoned in Japan because he got caught with drugs, I believe.

You say that from your perspective with your cultural background. Modern Japan may be westernized but it is certainly not western. The idea in these systems is also that it's on the state to prosecute responsibly and the assumption is made that if they are bringing charges it is for good reason.
>>
>>140107573
You can't bring culture into a logical discussion, if a behaviour is stupid, it is just stupid.

you sound like someone who doesn't interact with other cultures much.
>>
>>140107644
But to a number of cultures this is logic. You don't realize just how much of how we view the world is relative, do you? I don't believe the people that use moral relativism as an excuse but it is certainly a thing that has to be taken into consideration. Coming from societies with a background in common law and putting an emphasis on the individual, we take that stance.
>>
>>140107178
>it's better to have 10 criminals free than 1 innocent in jail
'no'
>>
>>140107690
I'm who I am only partially because of the culture I've been born into. That certainly doesn't stop me from using my brain.
If I see something I think is wrong I don't stop trying to change it only because "it's part of my culture". Culture is something that changes with time.
>>140107720
That an excuse to leave things as they are. You really believe everyone in the western world thinks Beccaria was right and the law system should be based around those ideals? Please.
>>140107818
Unless you live in a shithole that's literally your country's law system.
>>
>>140107875
>You really believe everyone in the western world thinks Beccaria was right and the law system should be based around those ideals? Please.
Of course I don't anon but the fact is that the ideals most adopt are deeply rooted in that of the society they are born into. Your viewpoint is also rooted in it too, no matter how you may attempt to not let it sway your decision making.
>>
>>140102416
>You'll find it has one of the lowest incarceration rates if you take out the prison's animal control role.
276805200 non-black citizens
1398789 non-black prisoners
Minus blacks, we'd have an incarceration rate of about .5% --so instead of having the second highest incarceration rate on earth, we'd only have the *seventh*! Neck-and-neck with Cuba! Eat that, Japan!
>>
there was a case about mayoi being suspected of being a shit

>>
>>140092854
Only if you're suspect of murder.

>>
>>140108021
But you'd probably do marginally more police work than 'we found the victim's sister crying over her body and a receipt with her name on it' before deciding that she's the killer.
>>
>>140107875
As others have alluded to, you seem to be under the impression that your brain is inherently a logic machine. It's not. Your brain is primarily a learning machine.

Your logic and morals and ethics are learned from experience, culture, and your self-reflection on those things.

You can see even from people in this thread that not everyone sees the same things as wrong. It's not because they're not using their brains. They have different brains.
>>
>>140107897
>the fact is that the ideals most adopt are deeply rooted in that of the society they are born into

The way the US prison system is set up, prison is absolutely not the solution. As a society, we would have less problems if we just executed every single criminal after sentencing than continue conducting the prison system as is. When the system becomes entirely public, nonprofit, and focused on rehabilitation AND punishment, then prison will be the solution.
