If a legal precedent like this happens, then there no longer is too much money in it. Suddenly corporations know that there's a limit to this clickbait bullshit, and they can't go that far with it again.
Some of them are scared off by this, and others even out a bit and become slightly less fucked up.
In order to test the system and get people to straighten out, you need someone to be the fall guy in order to set an example for the others. Gawker dying is the example for the others that they need to fly right again.
Its not a perfect system, but as long as there's occasional repercussions, then people do mostly stay in line. You can't think that the 1st amendment gives you the right to do literally anything if you call yourself a news publication, although there are also many ways it shouldn't be infringed.
