Mie's suicide was anti-climactic and weird because
1. there was a lot of foreshadowing of Mie being the third "monster" that never paid off or went anywhere
2. Mie seemed totally fine and even jubilant with Fujiki slaying Seigen, it was only when Fujiki complied with the command to behead Seigen's corpse that she went ashen-faced and lost the will to live, which is weird characterisation and doesn't make much sense.

That's because the main thing is not about their rivalry anymore. There's no need for huge panels and cool moments, nor for unexpected techniques.
Both Seigen and Gennosuke have already won/lost against each other at some point, both aren't actually driven by anger and hate anymore.
The last chapters are more about the meaning and the purpose of being a samurai, and its nefarious consequences. And about how little and trivial men are compared to the elite of the society.
Seigen/Gennosuke's struggles up to that point, their relationship, the huge tactical thinking that both had to prepare just for that single duel are easily dismissed by idiots whose only merit is being highborn. Tokugawa destroys Gennosuke's pride with just a few words, and he can't do anything but comply.
Mie's a really complex character, reread it if you have time. She kills herself not because of Seigen, but because she realises that Gennosuke actually didn't grow up a single bit. That he's exactly like her father, that if ordered he'd actually allow her to be raped. Gennosuke's speaking of seashells proves to be bullshit compared to what he actually does, when ordered to.

This is interesting and I hadn't thought of that before. I'd argue that Kogan didn't merely allow things like Gennosuke did , but actually ordered her to be restrained so the male with the strongest seed could breed her.
I find it hard to believe that mie thought Fujiki to be like her father, but I can see that him beheading Seigen's corpse as ordered would so that he lacked backbone and maybe mie wouldn't want to spend her life with such a man.
Still the lack of payoff to saying that "a third monster was born that night" about Mie remains annoying.

Also, he leaves a seashell next to Mie's bed when she's sleeping.
While his feelings and beliefs may be genuine, they immediately turn out to be bullshit the moment someone gives him orders.
Shigurui manages to depict all the warriors as cool/extraordinary individuals, but at the same time as the very reason why that feudal society was so wrong. Gennosuke can be seen as brave, dutiful and so on, especially when you can see his reasoning. But his actions clearly suggest that he's a full blown, numb-minded psychopath.
Mie doesn't want that.
Actually, the very first reason she falls in love with Seigen it's because he ISN'T like the other samurais, because he values indipendence and because he even dares to challenge authority.
Actually, the only true positive message of Shigurui comes right from the mouth of the antagonist. That's one of the reasons why I love this manga.

I'm pretty sure most everybody who makes, and reads these are aware of what the nature of the fiction they are participating in implies. They aren't trying to pass one over you. They are doing exactly what they are setting out to do. Which is making exciting stuff happen.

Of course they could be improved. Everything can. Its just as the same as everything else, people place different focuses on certain things in sacrifice to others. I think there is plenty of capability for mangaka to grow and change. They are creators after all, most of them are familiar enough with expression to be able to see holes and gaps in themselves. (At least i hope so) The thing is, world building and consistency that can be largely argued to be in the eye of the beholder. People tend to argue about things like this a lot simply because of that varying level of preference. For example, I'm the kind of person who surrenders himself easily to these kinds of holes in manga/anime but i dont have nearly as much tolerance with other media such as books or movies. And i think that is just fine.
For the record, besides the kind of unnecessary quote chain earlier, i think your perspective and argument are perfectly legitimate. One of my best friends is a lot similar to you in the way you describe things like this, and you both have good points. It just largely comes down to different strokes kinda thing.
