Yes, Akainu killing people does make him a villain. The only way you could sidestep this is if you were arguing from an appeal to authority. Him being employed to murder innocent people doesn't absolve him from having murdered innocent people.
And this is to say nothing of the fact that, as a reader, you know the government's goals in Ohara were self-protecting. The only possible way you could reason Akainu into being in the right is if you give the state full moral authority, which is exactly what you've been doing for this entire argument.
